1. Default Liability (Owner’s Risk)
1.1. Unless optional Transit Insurance is explicitly selected, declared, and paid for during the booking process, all goods are transported, handled, and stored strictly at the Owner’s Risk.
1.2. SPX Dynamix (SPXD), its employees, and its sub-contractors shall not be held liable for any loss, damage, theft, or destruction of goods, regardless of how such loss or damage occurs, including but not limited to negligence on the part of the Company.
1.3. In the absolute discretion of SPXD management, any ex-gratia compensation provided for uninsured goods will be strictly limited to the total cost of the transport fee paid by the Client for that specific shipment, or a maximum of R50.00 per physical kilogram, whichever is the lesser amount.
2. Optional Transit Insurance
2.1. To protect valuable cargo, Clients may opt-in for Transit Insurance during the online checkout or manual quoting process.
2.2. Declared Value: The insurance premium is calculated based on the “Declared Value” entered by the Client.
2.3. Maximum Payout: In the event of an approved claim, the maximum compensation paid to the Client will be strictly limited to the Declared Value entered at checkout, or the actual proven replacement cost of the goods, whichever is lower.
2.4. Under-declaring the value of goods to reduce the insurance premium will result in the application of the “Average Rule” by our underwriters (e.g., if you insure a R10,000 item for R5,000, you will only receive 50% of any claimed damage).
3. Packaging & Preparation (Client Responsibility)
3.1. SPXD is a transport and logistics provider, not a professional packing service. The Sender is solely responsible for ensuring that all items are securely, sufficiently, and appropriately packaged to withstand the normal rigors of road freight and handling.
3.2. Zero Liability for Poor Packaging: No insurance claims will be entertained or approved—even if Transit Insurance was purchased—if the loss or damage is deemed by our assessors to be the direct result of inadequate, flimsy, or insufficient packaging.
3.3. Fragile items (e.g., glass, electronics, ceramics) must be explicitly marked and packed in heavy-duty, impact-resistant materials.
4. Exclusions (What is Not Covered)
Even if Transit Insurance is purchased, SPXD and our underwriters will not accept liability for:
Consequential Loss: Loss of profits, loss of contracts, or any indirect financial losses resulting from delayed, damaged, or lost freight.
Prohibited Items: Cash, bullion, jewelry, precious metals/stones, fine art, antiques, hazardous chemicals, explosives, or illegal substances.
Inherent Vice: Damage caused by the natural deterioration or inherent flaws of the goods (e.g., perishable food spoiling, rust, temperature sensitivities).
Acts of God: Loss or damage caused by extreme weather, floods, earthquakes, or severe natural disasters.
Mechanical/Electrical Derangement: Internal damage to electronics or machinery where there is no visible external damage to the packaging.
5. Warehouse & Storage Liability
5.1. Goods booked for secure storage at the SPXD HQ Warehouse are covered against major perils (fire, structural damage, and forced-entry theft) up to the declared value, provided the storage fees are fully paid and up to date. 5.2. SPXD assumes no liability for goods confiscated by South African Police Services (SAPS), Customs (SARS), or any other regulatory authority.
6. Claims Procedure & Time Limits
6.1. Visual Inspection: The Receiver must inspect the outer packaging upon delivery. Any visible damage must be explicitly noted on the driver’s electronic or physical Proof of Delivery (POD) waybill.
6.2. Notification Limit: All claims for loss or damage must be reported to SPXD in writing (via email to our accounts/support department) within 48 hours of the delivery timestamp. Failure to report within this window automatically voids any claim.
6.3. Required Documentation: To process a claim, the Client must provide:
The SPXD Order/Waybill Number.
Clear photographic evidence of the damaged goods AND the original packaging.
Original commercial invoices proving the actual cost/value of the goods.
6.4. SPXD reserves the right to dispatch an independent assessor to inspect the damaged goods and packaging before any claim is approved.
