Standard Trading Conditions & Terms of Service

1. General Provisions

1.1. These standard terms and conditions (“Terms”) govern all transport, logistics, and warehousing services provided by SPX Dynamix (“the Company”, “SPXD”, “we”, or “us”) to the customer (“the Client”, “you”). 

1.2. By booking a service through the SPXD website, portal, or via a manual quotation, you agree that these Terms constitute a legally binding agreement. 

1.3. All business is undertaken strictly subject to these conditions. Errors and Omissions Excepted (E&OE).

 

2. Quotations, Pricing & Payments

2.1. Automated Quotes: The online logistics engine calculates pricing based on the exact dimensions, weight, and distance provided by the Client. 

2.2. Discrepancies: If the actual cargo exceeds the stated weight, dimensions, or quantity upon collection, SPXD reserves the right to refuse the load, require an upgraded vehicle (e.g., upgrading from a Bakkie to a 4-Ton truck), and charge the corresponding manual rate difference. 

2.3. Payment: All online bookings must be paid in full via our secure payment gateway (PayFast) prior to dispatch unless a formal corporate account with alternative terms has been approved.

 

3. Collection & Delivery

3.1. Packaging: The Client is solely responsible for ensuring that all goods are securely and adequately packaged for standard road freight transport. SPXD is not liable for damage resulting from insufficient packaging. 

3.2. Loading/Unloading: Automated quotes assume standard loading and unloading times. Excessive delays at the collection or delivery point caused by the Client may result in additional standing-time surcharges. 

3.3. Failed Collections/Deliveries: If our dispatch team arrives at the designated location and time, and the collection/delivery fails due to the Client’s unavailability, incorrect address, or unreachable contact numbers, a wasted journey fee will apply. Re-delivery will be quoted as a new trip.

 

4. Secure Warehousing & Storage

4.1. Storage Bookings: Items booked for storage will be transported directly to the SPXD HQ Warehouse in Bredell. 

4.2. Storage Fees: Fees are calculated dynamically based on cargo volume and the number of requested storage days. 

4.3. Retrieval: Clients must use the Customer Portal to initiate a “Retrieve Storage” delivery. Retrieval transport is subject to standard delivery routing and availability. 

4.4. Abandoned Goods: If storage terms expire and items remain unpaid or uncollected for a period exceeding 90 days, SPXD reserves the right to sell, dispose of, or auction the goods to recover outstanding warehousing and legal costs, in accordance with South African law.

 

5. Prohibited & Hazardous Goods

5.1. SPXD strictly prohibits the transport or storage of the following items unless explicitly agreed upon in writing:

  • Illegal or stolen goods.
  • Hazardous, corrosive, explosive, or highly flammable materials.
  • Firearms, ammunition, or explosives.
  • Live animals or livestock.
  • Cash, bullion, precious metals, or loose precious stones. 5.2. The Client indemnifies SPXD against any legal action, fines, or damages resulting from the undeclared transport of prohibited items.

 

6. Transit Insurance & Liability

6.1. SPXD takes the utmost care in handling your cargo. However, all goods are transported at the owner’s risk unless Transit Insurance is explicitly selected and paid for during booking. 

6.2. Insurance Valuation: Insurance payouts are strictly valued at the declared amount entered during checkout. Incorrect or understated values entered by the Client will not be compensated by SPXD Couriers or its underwriters beyond the declared amount. 

6.3. SPXD’s maximum liability for uninsured goods is limited to the standard industry rate as determined by the National Bargaining Council for the Road Freight and Logistics Industry (NBCRFLI) or as otherwise stipulated by South African freight laws.

 

7. Cancellations & Refunds

7.1. Standard Cancellations: Bookings cancelled before a vehicle has been dispatched will be fully refunded, less a standard 5% administrative and payment gateway fee. 

7.2. Late Cancellations: If a booking is cancelled after the vehicle has already been dispatched to the collection address, the Client will be liable for a minimum call-out fee or up to 100% of the transport cost, at the discretion of dispatch management.

 

8. Privacy & POPI Act Compliance

8.1. SPX Dynamix is committed to protecting your personal information in compliance with the Protection of Personal Information Act (POPIA). 

8.2. We collect only the necessary data (names, addresses, contact details, and cargo specifics) required to execute our logistics and storage services. 

8.3. We do not sell or share your data with third parties, except for secure payment processors (e.g., PayFast) or where required by law.
